Piper Alderman is representing all business and residential electricity consumers in Queensland in a class action brought against electricity generators, Stanwell Corporation Limited and CS Energy Limited. The QLD Energy Class Action is a legal claim that alleges Stanwell and CS Energy gamed the electricity pricing system and artificially inflated consumer’s electricity bills between August 2014 and December 2019.
Stanwell and CSE are responsible for roughly 70% of the electricity dispatched to the National Electricity Market (NEM) in Queensland and yield a significant amount of market power. According to Piper Alderman this conduct is in violation of section 46 of the Competition and Consumer Act 2010 (Cth) where the generators misused their market power for the purpose of deterring or preventing competitive conduct in the NEM.
Australian retail electricity prices have increased by approximately 80-90% over the past decade and these price increases have not been matched by any other areas of the economy, nor in national wage growth. The action presents an opportunity to highlight misconduct and prevent it from reoccurring in the future.
